1. Agreement to these terms

• any specific revenue or return on investment;
• uninterrupted availability of third-party platforms;
• approval by advertising platforms, telecommunications providers, search engines, or other third parties; or
• any particular business outcome.

Any examples, projections, case studies, testimonials, estimates, or descriptions of prior results are illustrative only and do not guarantee future performance.

6. Intellectual property rights

Unless otherwise indicated, the Services and their contents are owned by or licensed to 5 Star Visibility.

The Services may include:

• text;
• graphics;
• logos;
• trademarks;
• service marks;
• photographs;
• videos;
• designs;
• software;
• code;
• databases;
• reports;
• downloadable materials; and
• other content.

This content is protected by applicable copyright, trademark, intellectual property, and unfair competition laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal use or internal business purposes.

If you voluntarily provide feedback, suggestions, ideas, or recommendations concerning our Services, you authorize us to use that feedback for lawful business purposes without compensation or attribution to you. Your use of a third-party website or service is governed by the third party’s terms and policies. You should review those terms and policies before using the third-party service.

The inclusion of a third-party link does not necessarily mean that 5 Star Visibility endorses or is affiliated with the third party.

11. SMS and text messaging terms

11.1 Program name and description

5 Star Visibility, LLC operates the 5 Star Visibility text messaging program.

Individuals who expressly opt in may receive recurring SMS or MMS messages from 5 Star Visibility.

Depending on the consent provided and the individual’s relationship with us, messages may include:

• responses to inquiries;
• consultation confirmations and reminders;
• appointment confirmations and reminders;
• customer support communications;
• service, project, or account updates;
• administrative or transactional notifications;
• follow-up communications;
• information about our services; and
• promotional offers and marketing communications.

Marketing and promotional text messages will be sent only when the recipient has separately and expressly agreed to receive them.

11.2 Enrollment and consent

You may enroll in the text messaging program through an online form or another opt-in method made available by 5 Star Visibility.

By providing your mobile phone number and affirmatively opting in, you authorize 5 Star Visibility to send recurring text messages to the mobile number you provided.

Messages may be sent using automated technology.

Your consent applies only to 5 Star Visibility and the specific messaging program for which you enrolled.

Consent to receive marketing or promotional text messages is not a condition of purchasing any goods or services.

Consent to receive transactional, appointment, support, or service-related messages does not automatically constitute consent to receive marketing or promotional text messages.

By enrolling, you represent that:

• you are the subscriber or customary user of the mobile number provided;
• you are authorized to consent to receiving messages at that number;
• the mobile number is accurate; and
• you will notify us if the number changes or is reassigned.

Do not provide a mobile phone number that belongs to another person unless you are legally authorized to provide consent for that number.

11.3 Message frequency

Message frequency may vary based on your interactions with 5 Star Visibility and the types of communications you requested.

You may receive up to 8 promotional or marketing messages per month.

Transactional, appointment, customer support, administrative, account, project, and service-related message frequency may vary depending on your interactions with us.

11.4 Message and data rates

Message and data rates may apply.

Your mobile carrier’s standard messaging, data, and other charges may apply to messages sent or received as part of the text messaging program.

5 Star Visibility does not charge a separate fee for participation in the text messaging program, but your mobile carrier may charge you according to your wireless plan.

Contact your mobile carrier if you have questions about your messaging or data plan.

11.5 Opting out

You may revoke your consent to receive text messages at any time by replying STOP or by using any other words that reasonably communicate your desire to stop receiving messages, including QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE. You may also submit an opt-out request by contacting us at sales@5starvisibility.com or (954) 289-5555.

We will honor reasonable opt-out requests in accordance with applicable law. After submitting an opt-out request, you may receive one non-promotional message confirming that your request has been processed. Unless you subsequently provide new consent, no further messages covered by the revoked consent will be sent.

11.7 Mobile carrier disclaimer

Mobile carriers are not liable for delayed or undelivered messages.

Message delivery is subject to the availability and operation of wireless networks, telecommunications systems, messaging providers, supported devices, and other systems outside the control of 5 Star Visibility.

Delivery of every message is not guaranteed.

The text messaging program may not be available through every mobile carrier or on every device.

11.8 Mobile information and consent data

5 Star Visibility does not sell, rent, transfer, or share mobile phone numbers, SMS opt-in data, or messaging consent with third parties, affiliates, lead generators, advertisers, or other organizations for their marketing or promotional purposes.

Mobile information may be disclosed only to service providers that support the delivery, administration, security, and operation of the text messaging program, including telecommunications carriers and messaging platform providers.

These service providers may process mobile information only as necessary to provide services on our behalf and may not use the information for their own marketing or promotional purposes.

SMS consent provided to 5 Star Visibility is not transferable to another business, affiliate, partner, lead generator, advertiser, or organization.

11.9 Changes to or termination of the messaging program

We may modify, suspend, or discontinue the text messaging program at any time.

We may also change the phone number or short code used to operate the program.

If the sending number changes, messages sent to a previous number may not be received. You are responsible for following the instructions contained in communications from the current sending number.

Changes to the messaging program will not remove your right to opt out.

12. Email and other electronic communications

By visiting the website, submitting an online form, sending us an email, or otherwise communicating with us electronically, you agree that we may respond electronically.

Electronic communications may include:

• responses to inquiries;
• consultation communications;
• service-related notices;
• administrative communications;
• legally required disclosures; and
• marketing communications when permitted by law.

You may unsubscribe from marketing emails by using the unsubscribe link included in the email or by contacting us.

After unsubscribing from marketing emails, you may continue to receive non-promotional communications relating to inquiries, active services, appointments, transactions, security, legal requirements, or customer support.

General acceptance of these Terms does not by itself constitute consent to receive marketing text messages.

13. Availability, modifications, and interruptions

We do not guarantee that the website or Services will always be available, secure, complete, or error-free.

The Services may be interrupted because of:

• internet or telecommunications outages;
• third-party platform failures;
• cybersecurity incidents;
• events outside our reasonable control; or

This section does not limit obligations contained in a separate written agreement between you and 5 Star Visibility.

14. Disclaimer of warranties

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

5 Star Visibility disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of:

• merchantability;
• fitness for a particular purpose;
• title;
• non-infringement;
• accuracy;
• reliability; and
• availability.

We do not warrant that:

• the Services will meet every requirement;
• the Services will be uninterrupted, timely, secure, or error-free;
• defects will always be corrected;
• the Services will be free from viruses or other harmful components;
• information displayed through the Services will always be accurate or current; or
• the use of the Services will produce any particular result.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, these exclusions apply only to the extent permitted by law.

15. Limitation of liability

To the fullest extent permitted by applicable law, 5 Star Visibility and its members, managers, officers, employees, contractors, representatives, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to the Services.

This includes damages for:

• loss of profits;
• loss of revenue;
• loss of business opportunities;
• loss of data;
• loss of goodwill;
• business interruption; or
• the cost of substitute services.

To the fullest extent permitted by applicable law, the total aggregate liability of 5 Star Visibility for claims arising from or relating to the Services will not exceed the amount you paid directly to 5 Star Visibility for the specific Services giving rise to the claim during the six months immediately preceding the event giving rise to the claim.

If you have not paid 5 Star Visibility for the Services giving rise to the claim, our total aggregate liability will not exceed one hundred United States dollars.

These limitations apply regardless of the legal theory asserted and even if 5 Star Visibility was advised of the possibility of the damages.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

16. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless 5 Star Visibility and its members, managers, officers, employees, contractors, representatives, and agents from third-party claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys’ fees arising from:

• your unlawful use of the Services;
• your material violation of these Terms;
• information or materials you submit through the Services;
• your infringement of another person’s rights; or
• fraud, willful misconduct, or unlawful conduct by you.

We reserve the right to control the defense of a matter subject to indemnification. You agree to provide reasonable cooperation in connection with the defense.

This section does not require you to indemnify 5 Star Visibility for conduct for which indemnification is prohibited by law.

17. Suspension and termination

We may suspend, restrict, or terminate your access to the Services if:

• you violate these Terms;
• your use presents a security or legal risk;
• your use may harm 5 Star Visibility or another person;
• fraudulent or unlawful activity is suspected;
• continued access is not commercially reasonable; or
• the Services are discontinued.

Provisions that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution.

Termination of access to the website does not automatically terminate a separate written service agreement unless that agreement provides otherwise.

18. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Subject to any mandatory rights or procedures that cannot be waived under applicable law, any legal action arising from or relating to these Terms or the Services must be brought in a state or federal court located in Broward County, Florida.

You and 5 Star Visibility consent to the personal jurisdiction of those courts.

Before filing a legal action, the parties agree to make a reasonable good-faith effort to resolve the dispute informally.

A party seeking informal resolution must provide written notice describing the dispute and requested resolution. The parties will have at least 30 days after receipt of the notice to attempt to resolve the matter, unless immediate legal relief is reasonably necessary.

These Terms do not require binding arbitration.

19. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law.

If the provision cannot be enforced, it will be severed from these Terms without affecting the validity and enforceability of the remaining provisions.

20. No waiver

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other provision.

A waiver is effective only if it is in writing and authorized by 5 Star Visibility.

21. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, change of control, or other lawful business transaction.

Any assignment remains subject to applicable privacy and SMS consent restrictions.

SMS consent and mobile opt-in data will not be transferred for the marketing or promotional purposes of another business.

22. Entire agreement

These Terms, our Privacy Policy, and any applicable separate written agreement constitute the entire agreement between you and 5 Star Visibility regarding the matters they address.

If a separate written service agreement conflicts with these Terms, the separate written agreement will control with respect to the professional services covered by that agreement.

23. Changes to these terms

We may update these Terms to reflect changes in:

• our Services;
• our business practices;
• technology;
• legal or regulatory requirements;
• telecommunications requirements; or
• other relevant circumstances.

The updated version will be identified by the “Last updated” date at the beginning of these Terms.

Unless otherwise stated, changes become effective when the updated Terms are posted on our website.

If required by law, we will provide additional notice of material changes.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms, except where applicable law requires another form of consent.

Changes to these Terms do not replace any separate consent required for marketing or promotional text messages.
